«Η ιδιότητα του πατέρα είναι λόγος πρόωρης αποφυλάκισης»

Τα κενά του νέου νόμου της συνεπιμέλειας επεσήμανε η δικηγόρος Φανή Γιωτάκη, που όπως εξήγησε θα μπορέσει να χρησιμοποιήσει ο 33χρονος για να τύχει ευνοϊκότερης μεταχείρισης αν διατηρήσει τη γονική μέριμνα.

Ο νέος νόμος για τη συνεπιμέλεια έχει παραθυράκια, σύμφωνα με τη δικηγόρο Φανή Γιωτάκη, μέλος της Επιτροπής Οικογενειακού Δικαίου, τα οποία μπορεί να χρησιμοποιήσει ο Μπάμπης Αναγνωστόπουλος προκειμένου να τύχει ευνοϊκότερης μεταχείρισης για τη γυναικοκτονία στα Γλυκά Νερά.

Αυτό δείχνουν εξάλλου και οι δηλώσεις του δικηγόρου του κατηγορούμενου που τον εμφανίζουν ως στοργικό πατέρα που ενδιαφέρεται για το μέλλον του παιδιού του.

Οι δηλώσεις ότι ο δολοφόνος συνεχίζει να είναι πατέρας, είναι σύμφωνα με την κ. Γιωτάκη απόδειξη ότι θα κάνουν χρήση των κενών στο νέο οικογενειακό δίκαιο, καθώς μπορούν να επικαλεστούν ότι δεν έχει υπάρξει οριστική καταδίκη για ενδοοικογενειακή βία.

Όπως εξηγεί η δικηγόρος στο MEGA, τα κενά αυτά δίνουν πάτημα στη διατήρηση των γονικών δικαιωμάτων του 33χρονου, αρά και σε ευνοϊκότερες ρυθμίσεις αποφυλάκισης ως γονέα σε περίπτωση που καταδικαστεί.

«Αυτός ο άνθρωπος όσο θα παραμένει μέσα, ένας λόγος πρόωρης απόλυσης του θα μπορεί να είναι ότι θέλει να φροντίζει το παιδί γιατί θα έχει κρατήσει τη γονική μέριμνα.

Αυτό που αλλάζει με το νέο οικογενειακό δίκαιο είναι ότι υπάρχουν κάποια νομικά παραθυράκια τα οποία προφανώς θα κάνει χρήσει ο καθ’ ομολογία δολοφόνος γιατί μπορεί να επικαλεστεί ότι δεν έχει οριστική καταδίκη για οικογενειακή βία», σημείωσε.

Το κλειδί, όπως θα αποδειχθεί τις επόμενες μέρες, είναι η γονική μέριμνα. Αν ο καθ’ ομολογία δολοφόνος καταφέρει να την διατηρήσει, πιθανότατα θα καταφέρει να παίρνει άδειες μετά την καταδίκη του ή ακόμη και να αποφυλακιστεί πρόωρα.

«Φυσικά και θα το χρησιμοποιήσει ο δικηγόρος του αυτό. Είναι μια διάταξη που μπορεί να πατήσει πάνω και να έχει ένα παραθυράκι για να κρατήσει τη γονική μέριμνα. Μα το έχει πει ήδη. Το έχει δηλώσει και ο συνήγορός του, ότι εξακολουθεί να είναι πατέρας. Δεν μπορεί να χάσει την ιδιότητα του πατέρα.»
